Segundo.§ 211.204 Medicamentos devueltos.
Cláusula de devoluciones (PAHO/ONU – adquisiciones y exportación farmacéutica):
En atención a las obligaciones de control de calidad aplicables a productos devueltos previstas en la NOM-059-SSA1-2015, numeral 5.8 (Devoluciones), las Partes acuerdan que toda venta será definitiva y que no se aceptarán devoluciones salvo que el Vendedor emita previamente una Autorización de Devolución (RMA) por escrito; en su caso, cualquier producto autorizado para devolución deberá mantenerse bajo custodia controlada, en cuarentena/retención, y quedará sujeto a evaluación y dictamen del Área de Calidad del Vendedor (y, en su caso, del fabricante) para su liberación, reposición, nota de crédito, reembolso o disposición final conforme a Buenas Prácticas aplicables, sin que procedan devoluciones por cancelación, sobreinventario, cambios de demanda o cualesquiera causas no imputables al Vendedor.

In accordance with the quality-control obligations applicable to returned products set out in NOM-059-SSA1-2015, Section 5.8 (Returns), the Parties agree that all sales are final and that no returns will be accepted unless the Seller first issues a written Return Material Authorization (RMA); where a return is authorized, any such product must remain under controlled custody, in quarantine/hold, and will be subject to evaluation and disposition by the Seller’s Quality Unit (and, where applicable, the manufacturer) for release, replacement, credit note, refund, or final disposition in accordance with applicable Good Practices, and no returns shall be permitted due to cancellation, overstock, changes in demand, or any other causes not attributable to the Seller.
